Welcome to Wizpex. Please read these Terms carefully, as they set out your rights and obligations when using our platform. By accessing or using Wizpex, you accept and agree to these Terms. If you do not agree, please do not use the platform.

1. General Information

Wizpex s.r.o. (“Wizpex,” “we,” “our,” or “us”) is a company registered in the Czech Republic, with its registered office at Příčná 1892/4, Nové Město, 110 00 Praha. Wizpex operates this platform to connect Experts advertising their services with Users seeking those services. Payment for services takes place directly between Customers and Experts, outside the Wizpex platform.

Role of Wizpex.

Wizpex is an advertising platform. Experts publish advertisements for their services, Users browse those advertisements and reviews, and the two sides may communicate through private messages and booking-request tools on the platform. A Customer may ask a question or request a time; the Expert may accept, propose another time or decline, and the Customer may accept, decline or suggest a different time. A time is not confirmed until both sides agree.

Wizpex is not a party to the agreement.

Any agreement for the provision of a service is concluded solely between the Customer and the Expert, outside Wizpex. Wizpex is not a party to that agreement. Wizpex does not provide the advertised services, does not arrange, supervise or guarantee them, does not act as an agent, employer or representative of either side, and does not process payments for them.

What this means in practice.

The scope of the service, the price, the time and place, the method of payment and any documents (contract, invoice, receipt) are agreed between the Customer and the Expert. They may use Wizpex to exchange messages, request or propose a time, confirm it and record a cancellation, but those platform actions do not make Wizpex a party to their agreement. Either side may cancel a booking through the platform; any cancellation terms or consequences must be agreed between the Customer and the Expert. All rights and obligations arising from their agreement, including consumer rights, warranty, complaints and withdrawal, apply between them.

Advertisements and reviews.

Advertisements are created by Experts and reviews are written by Users. Wizpex does not verify the accuracy of either and does not recommend or vouch for any Expert.

Free use of the platform.

Use of Wizpex is free of charge for both Users and Experts. Wizpex charges no fee for registration, for publishing an advertisement or for contacting an Expert, and takes no commission from services arranged through the platform.

Payment for services.

Services advertised on Wizpex are not free. The price is agreed directly between the Customer and the Expert and is paid directly to the Expert. Payments do not pass through Wizpex.

Future changes to fees.

Wizpex may introduce charges for individual features in the future. Any such change will be announced in advance, will take effect only from the date stated in the announcement, and will not affect services already agreed.

2. Governing Law and Jurisdiction

These Terms are governed by the laws of the Czech Republic. Any disputes arising from these Terms are subject to the jurisdiction of the Czech courts. Nothing in these Terms limits any mandatory consumer-protection rights you may have under Czech or European Union law that cannot be waived by agreement.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified or removed to the minimum extent necessary, and the remaining provisions will remain in full effect.

3. Definitions

• Wizpex: Wizpex s.r.o., including all of its related intellectual property.
• Portal / Platform: The website Wizpex.cz, where services are advertised and communication occurs.
• User / You: Any visitor, registered user, or customer of the Portal.
• Expert: A registered User able to post and advertise their services on Wizpex. “Expert” is the term Wizpex uses for a service provider.
• Expert / Vendor equivalence: Throughout these Terms and across the Wizpex platform, the term “Expert” has the same meaning as “vendor,” “seller,” or “trader” as those terms are used under applicable Czech and European Union consumer and commercial law. Any rights or obligations that the law attaches to a vendor, seller, or trader apply equally to an Expert, regardless of the term used.
• Customer: A User who has found an Expert on Wizpex, contacted them, received a service, and paid the Expert directly, outside the Wizpex platform.
• Content: Any material uploaded, posted, or shared on the Portal, including images, text, reviews, and advertisements.

4. User Responsibilities

Users are responsible for the following:

• You must be at least 18 years old and have full legal capacity under applicable law. By registering, you confirm you meet these requirements.
• Accurate information. You must provide accurate, current information and promptly update it in your account if it changes.
• Compliance with guidelines and law. You must follow all posting rules, respect other users’ rights (including privacy and intellectual property), and use the Portal in line with local, national, and international law.
• Risk awareness. You interact with Experts at your own risk. We encourage you to vet Experts and use caution when sharing sensitive information.
• Respectful conduct. You agree to engage with others respectfully and not to publish false, misleading, or defamatory statements about Wizpex or its services on any platform.
• No misuse of brand. You may not use the Wizpex name, logo, trademarks, or design elements without our written consent, or in any way that implies a false association or endorsement.
• No misrepresentation. You are not an employee, agent, or representative of Wizpex and must not present yourself as one. Using the Portal creates no employment, partnership, or agency relationship.

Additional Expert responsibilities:

• Expert accountability. Experts are solely responsible for the integrity, quality, and delivery of their services, and for full compliance with Czech law (including entrepreneur registration, business legalization, and tax obligations). Wizpex does not verify Expert legal compliance and is not liable for any Expert’s breaches.
• Entrepreneurial requirement. Experts must be individual entrepreneurs or members of a small business. Wizpex is designed to improve visibility for such providers.
• Information accuracy. Experts must provide accurate, truthful business information. Wizpex may suspend or delete accounts found to be inaccurate or ineligible.

5. Accounts

• To contact Experts, Users must register with a valid email address. Only registered Users may use the messaging system.
• Username restrictions. Usernames must not be offensive, impersonate others, or imply association with Wizpex (e.g., “Admin,” “Official”).
• Account security. You are responsible for keeping your password confidential and must notify us immediately of any unauthorized use.
• One account per user. Each User may hold only one account. Transferring account data to third parties is prohibited.
• Becoming an Expert. Any registered User may become an Expert through the Expert registration section of their account, providing a valid phone number and a Store Name (a storefront name or the Expert’s own name).
• Expert deactivation. Experts may switch back to a regular account at any time by deactivating their Expert Profile. On deactivation, all active service listings are permanently deleted. If the Expert re-registers later, profile data may be restored, but deleted listings cannot be recovered.
• Account deletion. Users may permanently delete their account, which erases associated data and listings. Deleted account data cannot be recovered; rejoining requires registering as a new user.
• Violations. If a User breaches these Terms, Wizpex may delete the account and block the associated email address from future registration.

6. User Content

By uploading Content to Wizpex, you confirm that it is:

• Owned or licensed by you, and free from viruses, malware, or other harmful elements.
• Copyright-compliant, respecting all third-party intellectual property rights.
• Lawful, complying with all applicable laws, including data-protection laws.

Ownership and responsibility.

You retain ownership of Content you upload. You are solely responsible for it, and you agree to indemnify Wizpex for any costs, damages, or legal claims arising from Content you upload that infringes third-party rights or breaks the law. Wizpex does not actively monitor uploads but may remove Content that violates these Terms or applicable law.

Marketing and promotional use (opt-in).

With your consent, Wizpex may use Content you upload for marketing and promotional purposes (for example, in advertising, social media, newsletters, or print materials). You can give or withdraw this consent at any time in your account settings or by contacting Wizpex Support. Withdrawing consent does not affect uses that already took place while consent was active.

Content removal and reporting.

Wizpex removes Content that is offensive, defamatory, illegal, or that infringes third-party rights. Users are encouraged to report such Content to Wizpex Support. We aim to resolve reports promptly and may block or delete accounts where necessary.

Prohibition on scraping.

You may not collect, copy, or redistribute Content from the Portal without our written permission. Unauthorized scraping or copying may result in suspension or deletion of your account.

Backups.

Wizpex performs routine backups for internal recovery purposes only. These are not guaranteed to preserve individual user Content. You are strongly advised to keep your own copies of any Content you upload. Wizpex is not liable for loss of Content.

User-submitted articles.

Users may submit original articles for publication. These are labeled “User Articles” with the author’s name displayed. Wizpex is not responsible for the accuracy, legality, or copyright status of such articles and may remove them in the event of a dispute.

7. Expert Reviews and Ratings

After a service is completed, Users may leave honest reviews.

• Soliciting feedback. Experts may request reviews but must not influence their content.
• Standards. Reviews must be respectful, accurate, and free from misleading or defamatory content.
• No false or offensive reviews. Knowingly false, misleading, offensive, or coordinated fake reviews are prohibited.
• Ratings. An Expert’s rating is based on the reviews they receive and is shown on their profile.
• No manipulation. Experts may not artificially inflate ratings. Wizpex may remove suspicious reviews and block offending accounts.
• Moderation. Wizpex may remove reviews containing insults, obscene language, political slogans, or other inappropriate content, and may delete or blacklist the responsible account.

Note: Wizpex does not verify reviews and is not responsible for their content.

8. Advertisement and Listing Rules

Experts must follow these rules when creating service listings:

• Advertisement limit. Experts may have up to three active service advertisements at any time.
• Listings must only serve to connect Experts with potential customers. Irrelevant, misleading, or non-service content is prohibited.
• No direct contact details. Listings must not include phone numbers, email addresses, or other direct contact details. All contact must occur through the platform’s private messaging.
• Accuracy and quality. Images and descriptions must accurately represent the service, be clear and high-resolution, free of watermarks or branding, and free of spelling or grammatical errors.
• Appropriateness. Content must not be offensive or inappropriate.
• Legal compliance. Experts are responsible for ensuring listings comply with applicable Czech law.
• Keeping listings current. Experts must promptly update listings when service details, pricing, or other key information change.

Review and publication.

Listings are reviewed and published by Wizpex staff in the order received. Processing times vary from minutes to several days depending on workload. Wizpex does not guarantee immediate publication but will make reasonable efforts to minimize delays. Listings are also subject to random compliance checks; a listing that violates the rules will be rejected or returned for revision with an explanation. Prohibited content (see Section 9) will be rejected, and repeated violations may lead to suspension or deletion of the account.

9. Prohibited Services and Content

Prohibited services.

The following are strictly prohibited on Wizpex:

• Illegal services. Any services or goods that violate Czech law, including unlicensed medical, financial, or legal services.
• Unregulated financial services. Training, advice, or assistance involving securities, cryptocurrencies, exchanges, or other unregulated financial operations.
• Weapons and hazardous materials. Repair, production, or sale of firearms, ammunition, explosives, or hazardous chemicals.
• Controlled substances. Production, sale, or promotion of alcohol, narcotics, tobacco, medications, or substances used to produce them.
• Gambling and betting. Including the repair or production of gambling equipment.
• Sexual services. Adult entertainment, escort services, or explicit content.
• Academic dishonesty. Writing seminar papers, theses, or other academic work in violation of academic integrity.
• Health-harmful services. Services promoting or involving dangerous health practices.
• Human trafficking or exploitation. Any related service.
• Debt collection. Debt-collection services or related activities.
• Extremism. Services promoting extremism, hate speech, or prohibited symbols.
• Rights infringement. Services that infringe third-party intellectual property or other rights.
• Surveillance and confidential information. Eavesdropping devices, encrypted-communication interception, or similar prohibited information.

Prohibited content.

• Offensive language. Threats, insults, or abusive behavior.
• Hate speech. Content inciting hatred, violence, or discrimination based on protected characteristics.
• IP infringement. Content violating copyrights, trademarks, or other rights.
• Political content. Propaganda or calls for violence or civil unrest.
• Fraud or unfair competition. Content promoting scams or unfair competition.
• Unauthorized external links. Links to external content not authorized by Wizpex. Wizpex is not responsible for any such link or its destination.

Wizpex may remove any content or service that it considers inappropriate, harmful, or unlawful, even if not expressly listed above, and will notify the provider of its decision.

10. Additional Expert Verification

Before an Expert may publish any service on Wizpex, they must verify their phone number by SMS. Verification confirms that the Expert is contactable at the number given; it does not verify professional skills, qualifications, or service quality.

Scope.

Verification confirms that the phone number belongs to the Expert and that they can be reached on it. Wizpex does not verify identity documents, professional skills, qualifications, or service quality.

Verification badge.

After successful verification, a badge appears on the Expert’s public profile.

Data storage and deletion.

Verification data is stored securely using industry-standard encryption and access controls, and is retained only while the Expert’s account is active. If the Expert’s details change (e.g., name or phone number), re-verification is required. Verification data is deleted when the account is deactivated. See the Privacy Policy for full details.

11. Privacy and Communication

Our handling of personal data is described in full in our Privacy Policy. In summary:

• Private messaging. Customers may contact Experts through private messages; Experts receive email notifications of new messages.
• Exchange of personal data. Once a service is agreed, Customers and Experts may exchange contact details through private messages. Users decide what to share, and do so at their own discretion.
• Expert confidentiality. Experts must treat all personal information received from Customers as confidential, must not disclose it without consent (unless required by law), and must comply with the GDPR and other applicable privacy laws.
• Platform role. Wizpex is not liable for data handling directly between Users and Experts; each Expert is responsible for its own data-protection compliance.

12. Disclaimer and Liability

To the extent permitted by law, and without limiting any mandatory consumer rights:

• Use at your own risk. Wizpex does not guarantee the accuracy, quality, or availability of the platform or any services advertised on it.
• Platform changes. Wizpex may modify, update, or discontinue any part of the platform at any time.
• Maintenance and outages. Scheduled maintenance may make the platform temporarily unavailable (we will give notice where possible). Unexpected outages may also occur. Wizpex does not guarantee uninterrupted or error-free access.
• Expert transactions. Wizpex is not responsible for the fulfillment or quality of agreements between Users and Experts.
• Malware. Wizpex is not liable for viruses or malware affecting your device while using the platform, to the extent permitted by law.
• Content. Users are solely responsible for ensuring their Content complies with applicable law.
• Third-party links. Wizpex is not responsible for external websites linked from the platform.

13. User Conduct and Termination

Naming and identity.

• Accuracy and readability. Usernames and business names must reflect your identity or business, be readable, and avoid misleading implications.
• Professionalism. Avoid offensive, profane, or suggestive language.
• Prohibited titles. Names implying official Wizpex affiliation (e.g., “Moderator,” “Admin”) are not allowed. Wizpex may change or delete non-compliant names.

Prohibited actions.

• Platform disruption. Do not disrupt, sabotage, overload, or impair the platform or others’ access.
• Malicious software. Do not introduce viruses, bots, Trojans, or unauthorized scripts or tools.
• Source code and security. Do not access, modify, or tamper with Wizpex’s source code, security protocols, or algorithms, or circumvent access controls.
• Data extraction. Do not scrape or harvest Wizpex data or user information without consent.
• Third parties. Do not authorize others to perform any prohibited action on your behalf.

Suspension, termination, and refunds.

• Suspension and bans. Wizpex may suspend or permanently ban accounts for violations of these Terms.
• Content removal. Wizpex may remove content that violates platform policies or is flagged as inappropriate.
• User-initiated deletion. Users may request account deletion, subject to our data-retention obligations.
• Refunds. Payments for services are made directly to Experts. Experts are solely responsible for any refunds; Wizpex does not process or guarantee refunds. This does not affect any statutory rights you may have against an Expert under consumer law.

14. Changes to These Terms

Wizpex may update these Terms from time to time. Significant changes will be announced on the Portal. Your continued use of Wizpex after changes take effect constitutes acceptance of the updated Terms. The “Last Updated” date at the top of this document shows when it was last revised.

15. Waiver

Failure to enforce any provision of these Terms, or to exercise any right to terminate, is not a waiver of that provision or right, and does not affect the validity of these Terms or the right to enforce them later.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, form the entire agreement between you and Wizpex s.r.o. regarding your use of this website.

17. Language

These Terms may be provided in several languages for convenience. In the event of any conflict or inconsistency between language versions, the Czech version prevails.
